Terms & Conditions
Last Updated: October 16, 2026
These Terms & Conditions describe service policies for Pro Kitchen Care LLC, DBA Pro Kitchen Care, in North Carolina. Please review them before authorizing service. Individual estimates, work orders, and invoices may contain additional job-specific terms.
1. Agreement to Terms
These Terms apply to services provided by Pro Kitchen Care LLC, DBA Pro Kitchen Care (the "Company"), including appliance diagnostics, repair, maintenance, installation, and related services. Customers should review these Terms before approving service. An enforceable agreement requires appropriate notice and acceptance; merely visiting this website does not necessarily establish consent to all service terms.
2. Scope of Services
Services are limited to the appliances and work described in the approved estimate, work order, or invoice. Additional parts, labor, or changes in scope require Customer approval and may involve additional charges. Website information is general and is not a diagnosis, safety determination, or guarantee of repairability.
3. Payment Terms
Unless otherwise agreed in writing, full payment is due upon completion of the authorized work. Invoices must be paid no later than five (5) calendar days after completion. Accepted payment methods may include cash, credit card, bank transfer, tap to pay, and check, subject to availability. Any late fees or collection charges apply only if separately agreed and permitted by law.
4. Estimates, Diagnosis and Additional Expenses
Estimates are based on information available at the time and may change if testing, disassembly, or service reveals concealed defects or additional work. The Company will request approval before performing additional billable work. Diagnostic or service-call fees disclosed before the appointment may remain payable even if repair is declined or impractical.
5. Warranty on Services and Parts
Unless a different period is expressly stated in the applicable invoice or written service agreement, the Company provides a thirty (30) day limited workmanship warranty beginning on the date the work is completed.
If the same malfunction is caused by defective workmanship within that period, the Company will evaluate and, where covered, correct that workmanship without additional labor charge.
Parts warranties, if any, are subject to the terms specifically stated on the invoice or applicable manufacturer or supplier documentation.
The warranty does not cover unrelated defects, failures of other components, misuse, improper maintenance, external utility problems, pre-existing conditions, or third-party work that causes or contributes to the failure. Nothing in this section limits rights that cannot legally be waived.
6. Liability, Pre-Existing Conditions and Customer Property
The Company is not responsible for pre-existing damage, concealed deterioration, improper prior repairs or installation, or failures unrelated to its work, except to the extent caused or worsened by the Company.
Customers should remove fragile or valuable items from the work area. To the extent permitted by law, the Company is not responsible for indirect or consequential losses arising from circumstances outside its agreed scope of work. No provision excludes liability that applicable law prohibits excluding.
7. Customer Obligations and Safe Access
The Customer must provide safe and reasonable access to the appliance, premises, and necessary utilities, disclose known hazards, and follow written operating and safety instructions.
Additional charges may apply for approved unusual access or removal work. The parties will identify any required permits and licensed work before proceeding; nothing here transfers a legal duty that applicable law places on the Company.
8. Cancellation, Rescheduling and No-Show
If the Customer cancels or reschedules with less than twenty-four (24) hours' notice, a cancellation fee of up to $80 may be charged if that fee was disclosed and agreed to when booking, subject to applicable law.
If access is unavailable at the agreed appointment time, the Company may charge reasonable previously disclosed trip or service-call fees.
9. Removed Parts and Components
Unless otherwise agreed in writing or prohibited by law, removed parts and components become the property of the Company after replacement.
The Customer may request to retain removed parts before work begins, subject to core-return, exchange, warranty, and lawful disposal requirements.
10. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules, except where mandatory law provides otherwise. Any court proceedings must be brought in a court with lawful jurisdiction and proper venue.
11. Severability
If a provision is found invalid or unenforceable, the remaining provisions will continue in effect to the extent legally permissible.
12. Custom Repairs, Modifications and Customer Consent
Some repairs may involve component substitution, circuit-board restoration, circuit redesign, software or hardware adjustments, or other nonstandard methods that differ from the original manufacturer design. Such work may be proposed when original parts are unavailable, discontinued, cost-prohibitive, or standard repairs are impractical.
Advance disclosure and authorization. Before a material custom modification, the Company will describe the proposed work and its reasonably foreseeable material risks and obtain express, verifiable Customer authorization through a signed estimate, work order, electronic approval, or other written record. Approval of ordinary repairs does not automatically authorize undisclosed custom modifications.
Risks and operating differences. Disclosed risks may include changes to indicators or diagnostic messages, operating sequences or timing, unexpected resets or interruptions, reduced compatibility with future manufacturer updates or parts, diminished future serviceability, additional repair costs, and performance or reliability that differs from original factory specifications. Manufacturer warranties, certifications, or approvals may also be affected.
Customer assumption of disclosed risks. By expressly authorizing the identified modification, the Customer acknowledges the disclosed risks and voluntarily accepts the inherent risks of that specific modification to the extent permitted by law. The Customer is responsible for misuse, unauthorized subsequent alterations, failure to follow written safety instructions, and continued operation after becoming aware of a potentially unsafe condition, to the extent those actions cause or contribute to a loss.
Safety and responsibility. The Company will not knowingly bypass required safety protections or perform work that violates applicable mandatory safety requirements. Existing breakers, fuses, GFCI/AFCI devices, or other protective equipment do not guarantee that a modification is safe or that damage cannot occur. Nothing in these Terms shifts responsibility for the Company's negligent work or other non-waivable legal duties to the Customer.
No factory-equivalence guarantee. Unless expressly agreed in writing, the Company does not guarantee identical factory performance, future compatibility, or long-term reliability of custom modifications. Any express warranty on the invoice remains subject to its stated terms and applicable law.
Payment and acknowledgment. Payment of the final invoice after completion may serve as additional evidence that the Customer received the services and acknowledges previously disclosed and agreed terms. Payment alone is not retroactive authorization of undisclosed modifications, nor an automatic waiver of legal claims. For material custom modifications, separate written approval should be obtained before work begins.
13. Acknowledgment of Consent
By signing or electronically approving an estimate, work order, invoice, or separate service authorization that clearly references these Terms, the Customer acknowledges receipt and acceptance of the applicable terms, subject to law. Service-specific written agreements take precedence over inconsistent general website terms to the extent expressly agreed.
14. Appointments and Scheduling
Submitting a service request does not guarantee an appointment, arrival time, parts availability, repair completion, or same-day service. Appointments may change because of traffic, weather, emergencies, earlier jobs, or supply delays.
15. Parts and Availability
Part prices, availability, shipping times, specifications, and supplier warranty terms may change. Substitutions requiring additional work or material differences will be disclosed for approval.
16. Unsafe Conditions
The Company may decline, suspend, or postpone work where gas, electrical, water, ventilation, structural, or other safety concerns are identified. Necessary corrective work may require an appropriately licensed contractor.
17. Taxes and Charges
Applicable sales tax and legally required charges will be added when required by law. Charges for additional work require approval as described above.
18. Professional Qualifications and Manufacturer Relationships
The Company may maintain insurance and relevant professional certifications. References to manufacturers and trademarks identify serviced products and do not imply authorization, sponsorship, affiliation, or endorsement unless expressly stated. Trademarks remain the property of their respective owners.
19. Electronic Communications
By providing contact information in connection with a service request, the Customer permits service-related communications about scheduling, estimates, invoices, and updates, subject to applicable law and any required consent for particular communication methods.
